Saajsaambhar has no control over the quality, texture, colour and other aspects of the items listed, however the products listed shall bear (a) sale price on length of fabric or unit price for Unstitched Dress Materials (b) description of fabric or Unstitched Dress Materials (c) measurement in gram/meter or unit only and all other conditions or fitness of quality or intended use of the product are disclaimed and the purchase is desired to exercise discretion to have sample of products ordered before taking delivery. Saajsaambhar reserves the right to change these Terms at any time.
Such changes will be effective when posted on the Website and may, at the Website’s sole discretion, be communicated to the Users from time to time. Notwithstanding the foregoing, by continuing to use the Website after we post any such changes, you accept the Terms as modified.

Such changes will be effective when posted on the Website and may, at the Website’s sole discretion, be communicated to the Users from time to time. Notwithstanding the foregoing, by continuing to use the Website after we post any such changes, you accept the Terms as modified.
1. You agree, undertake and confirm that your use of Saajsaambhar shall be strictly governed by the following binding principles:

Eligibility to use

Use of the Website is available only to persons who are legally capable of contracting under the Indian Contract Act, 1872. Persons who are “incompetent or not entitled to contract” within the meaning of the Indian Contract Act, 1872 shall not be eligible to use the Website. Any minor desirous of using or transacting on the Website must conduct such transactions through their legal guardian or parents.
The Website reserves the right to terminate any membership and/or refuse to provide access to the Website if it is brought to the Website’s notice or if it is discovered that the person accessing/using the Website is under the age of 18 years. By accepting the Terms or using or transacting on the Website, the User irrevocably declares and undertakes that he/she is of legal age,, 18 years or older and capable of entering into a binding contract. Such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.

Any person may access the Website and the Products either by registering on the Website or using the Website as a guest. If any User provides any information that is untrue, false, not updated, and incomplete, or the Website has reasonable grounds to believe that such information is untrue, false, not updated, incomplete, the Website shall have the right to suspend or terminate the relevant User account and refuse any current or future use of the Website (or any portion thereof).
The Website may be inaccessible for such purposes as it, in its sole discretion, deems necessary, including, but not limited to, regular maintenance. However, under no circumstances will Saajsaambhar be held liable for any losses or claims arising from such inaccessibility to the Users, and the Users expressly waive any claims against Saajsaambhar in this regard.
Users of the Website may be required to provide certain personal information and to expressly permit the Website to access,/or collect, and retain such personal information. Listing And Selling

By listing a Product on the Website, Saajsaambhar warrants that all such Products are legally permitted to be sold, and that the Product listed shall provide the most accurate description of the Product to be sold on the Website, including text, pictures, and other content that Saajsaambhar may require from time to time. Saajsaambhar would charge reasonable shipping and handling fees to cover the costs for packaging and posting the items, including for giving samples.
All sales on the Website are binding on both the User and Saajsaambhar, and the products shall be shipped by Saajsaambhar up to the point of delivery, or otherwise completed with the User, within 30 days, unless there is an exceptional circumstance or a force majeure event affecting supply. (or agreed upon)
Shipping of the products shall be subject to the operation of the logistics partner at the place of delivery, and if the shipping agent does not operate at that location, the products may be collected either directly from the store or from a location where the shipping agent is located. The delivery from the store shall be subject to verification by the user via SMS or email.
The display of the product on the website may differ from the actual product; therefore, the user is advised to request a sample before placing an order. We shall supply the sample, and a retention sample shall be retained by us at a price to be determined on a case-by-case basis. If the sample (here, Fabrics) is unavailable, the user may order 0.5 meters and inform us so that we can retain the counter sample. For bulk purchases, the user should inform us of the arrangement for a retention sample, for which the user must pay a portion of the future items to ensure retention of the item. Payment must be made in advance, and the user should confirm accordingly before arranging delivery of the sample item. No sample is applicable for a product category other than Fabrics.
We shall ensure that the product supplied in pursuance of verification of sample (for Fabrics only) shall conform to the sample, and we disclaim all other guarantees or warranties regarding the quality, colour, or fitness of the product.
To the fullest extent permitted under applicable law, Saajsaambhar shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with the sale, use, or inability to use any products purchased through the Website. Such excluded damages include, without limitation, loss of profits, loss of business opportunity, loss of revenue, loss of goodwill, business interruption, or any other commercial losses, even if Saajsaambhar has been advised of the possibility of such damages. In all circumstances, Saajsaambhar’s total aggregate liability arising out of any claim relating to the purchase of products shall not exceed the actual amount paid by the customer for the specific product giving rise to the claim. No claim shall lie against Saajsaambhar’s directors, officers, employees, agents, affiliates, or representatives in their personal capacity. Except as expressly provided in these Terms or as required under applicable law, Saajsaambhar disclaims all other warranties, representations, conditions, obligations, and liabilities relating to the sale of products on the Website.
In the case of bulk orders, we reserve the right to sell the products on terms as may be decided on a case-by-case basis at our discretion.
The terms of sale, as well as the offer of sale of products at discounts, shall be at our discretion.

Products & Price

The Website provides an online platform for various Sellers to advertise, display, make available, and sell Products (including services ancillary to the Products and services), vouchers, and services to Users of the Website (“Products”). The Website merely facilitates engagement between Users and Sellers and provides such other services as are incidental and ancillary thereto. Additionally, the Website reserves the right to terminate the services offered to Users at any time without notice.
All Products exhibited on the Website are on an “as is” and “as available” basis. Images of products are for reference only, and the actual product, including colour and weaving/printing patterns, may vary from the corresponding image shown. The Website disclaims any liability arising from any discrepancies in this regard.
About the products exhibited on the website, Saajsaambhar disclaims any guarantee or warranty regarding

(a) Quality of any products;

(b) Colour of the product supplied, including colour fading or fading;

(d) Exactness as to the finish and appearance of the Product as ordered by the User.

(e) Fitness as to quality or colour or any product that is subjected to any job work, for instance, of a customer.

Payments

Prices for Products as displayed on the website shall be construed to be part of the terms and conditions set out herein by reference. The prices of the products listed in the website shall be in Indian rupees. Users further undertake that, by initiating a transaction, the User is entering into a legally binding and enforceable contract with Saajsaambhar to purchase the products using payment facilities permitted by applicable laws and accepted by the Website.
The Website does not charge any registration/membership or browsing fee. However, the Website reserves the right to alter the fee policy from time to time, and, upon notification, such policies shall form part of the terms and conditions herein.
Saajsaambhar may enter into agreements with third-party payment gateway aggregators and financial institutions authorised by the Reserve Bank of India for the collection, refund, and remittance of payments, and to facilitate payments between Users and itself. The Website shall initiate remittance of payments made by the User, and the transaction shall be deemed completed after the Products are delivered to the User or received by us, whichever is applicable.
While availing any of the payment gateways available on the Website, the Website or Saajsaambhar will not be responsible or assume any liability whatsoever in respect of any loss or damage arising directly or indirectly to the User due to:

(a) Lack of authorisation for any transaction/s or

(b) Exceeding the preset limit mutually agreed upon by and between the User and the relevant banks of the User, or

(d) Illegitimacy of the payment methods (credit/debit card frauds, etc.) being used by a User;

(e) Decline of transaction for any other reason(s)

Notwithstanding anything herein, the Website reserves the right to conduct additional verification for security or other reasons if it is not satisfied with the User’s credibility.
All payment processing and delivery arrangements are carried out in accordance with the respective agreements between Saajsaambhar and its authorised payment gateway providers, banks, and logistics partners. The provision of payment facilities on the Website is solely for the convenience of Users. Saajsaambhar shall not be liable for any delay, failure, interruption, or error in payment processing or fund settlement caused by third-party payment service providers, banks, or financial institutions. In no event shall Saajsaambhar’s total liability arising out of or in connection with any transaction conducted through the Website exceed the actual amount paid by the User for the specific Product giving rise to the claim.
Every User hereby represents, warrants, and undertakes that:
- All information provided for the purpose of purchasing Products on the Website, including credit card, debit card, UPI, or other payment details, shall be true, accurate, current, and complete; and
- The User shall use only valid payment instruments that are lawfully owned by them or that they are duly authorised to use.
The Website shall not use or disclose any User information to third parties except as required by applicable law or in accordance with the terms of its Privacy Policy. While reasonable security measures are implemented to protect payment information, the Website shall not be liable for any loss, unauthorised access, or breach of confidentiality relating to credit card, debit card, UPI, or other prepaid payment instrument details, to the extent such loss arises from circumstances beyond its reasonable control, including acts or omissions of third-party payment service providers. The Website shall not be responsible or liable for any payment refusal, decline, authorisation failure, or transaction rejection by any bank, financial institution, or payment gateway.

Shipping and Delivery

All Products purchased from the Website shall be delivered to the User via standard courier services engaged by Saajsaambhar through its authorised logistics partners. All deliveries, where applicable, shall be made on a best-efforts basis. While the Website will endeavour to dispatch and deliver Products within the timelines communicated at the time of order confirmation, such timelines are indicative only. The Website shall not be liable for any delay in delivery arising from circumstances beyond its reasonable control, including, without limitation, logistical disruptions, force majeure events, governmental restrictions, or delays attributable to third-party courier services.
Saajsaambhar, the website, shall not be responsible for any delay in the delivery of the Products, nor liable for any damage to the Products in transit due to mishandling by the logistics partner. Delivery of the product to the shipping agent shall constitute delivery of the product to the customer, unless the product is returned undelivered.
The logistics partner supported by Saajsaambhar.com will make up to 2 attempts to deliver your order. If the User is unreachable or does not accept delivery of the products on these attempts, Saajsaambhar reserves the right to cancel the order(s) at its discretion.
Upon placing an order, you will receive an email confirmation containing a summary of the order details and the estimated delivery timeline applicable to your location. Notwithstanding the foregoing, delivery timelines are indicative only and may be extended due to force majeure events or other unforeseen circumstances beyond the Website’s reasonable control. In the event of a delivery delay, the Website may, at its sole discretion, notify the User of such delay by email, SMS, WhatsApp, or any other contact details provided by the User at the time of placing the order, subject to the User’s consent.
The Website shall not be held responsible and will bear no liability in case of delay in the delivery of the Products, including any damage or loss caused to the Products due to mishandling of the product by the courier service provider. Any delay in delivery of the Products caused by reasons beyond the control of the Website and/or the courier service provider shall not entitle the user to claim a refund for the Product.
If a Product is delivered in a damaged condition, the Seller shall, subject to verification and in accordance with the applicable replacement policy displayed on the Website for such Product, arrange for replacement of the Product.
No deliveries of the Products shall be made outside the territorial boundaries of India.
If a User wishes to get delivery to different addresses, the User shall be required to purchase the Products under separate transactions and provide separate delivery addresses for each transaction, as may be required. The User agrees that the delivery can be made to the person who is present at the shipping address provided by the User.

Return, Replacement and Refund

All Products purchased from the Website and successfully delivered to the User may be eligible for return to Saajsaambhar in accordance with the applicable return policy displayed on the Website. However, Saajsaambhar shall not be obligated to accept returns, and the User shall not be entitled to return a Product, in the following circumstances:
- The Product has been damaged, altered, or misused by the User;
- The Product shows any change in quality, quantity, condition, or other characteristics from the state in which it was delivered;
- The Product returned is not the same Product that was originally delivered.
- The Product consists of fabric or Unstitched Dress Materials that have been cut, customised, or supplied as per the specific order of the User; or
- Any other circumstances as may be specified in the Website’s Refund & Return policy or communicated by Saajsaambhar from time to time.
User would be entitled to return product to Saajsaambhar only in case: (a) Return exchange is initiated within 7 days of order delivery and product is defective and (b) The tags& labels on the product should be intact and (c) The product should be unwashed, unused and in an undamaged condition and has been kept in the condition as it was delivered.
